Terms of Service
The platform terms for using Aspire 2: CMS self-serve websites and admin tools.

1. Agreement
These Terms apply when you create an account, use the Aspire 2: CMS admin platform, publish a website, or use our related services. Aspire 2: CMS is a product operated by Mitchell Craig Roemling trading as Aspire 2: X, ABN 21 658 558 016, as a sole trader in Brisbane, Queensland, Australia.
2. Accounts
You must provide accurate account and business information, keep your login secure, and only invite users who are authorised to act for your business. You are responsible for activity under your account.
3. Service
Aspire provides a hosted CMS, website renderer, lead capture workflow, media storage, and subscription management tools. We use commercially reasonable efforts to keep the service available, but we do not promise a specific SLA for the MVP.
4. Trials, Billing, And Plans
Self-serve plans include a 14-day free trial. Billing is handled by Stripe. Plan limits, prices, and inclusions are shown on the pricing and billing pages. You are responsible for keeping payment details current.
5. Refunds
Our refund policy is at /legal/refunds. In short, we offer a full refund within 14 days of your first paid subscription charge. After that, we do not provide partial-month refunds unless required by law. Nothing in these Terms excludes rights you may have under the Australian Consumer Law.
6. Your Content
You keep ownership of business content you upload or create. You grant Aspire the rights needed to host, display, process, transmit, back up, and support that content as part of the service.
You warrant that you have the rights to use all uploaded content, including text, images, logos, staff photos, testimonials, reviews, and customer-submitted materials.
7. Acceptable Use
You must follow our Acceptable Use Policy. We may suspend or remove content that creates legal, security, abuse, or platform integrity risk.
8. Privacy And Data
Our Privacy Policy explains how we handle personal information. For tenant website enquiries, Aspire processes lead data to provide the CMS service to your business. You are responsible for your own business privacy obligations to your customers and website visitors.
9. Termination And Data Export
You may cancel through the billing page or by contacting support. You should request any export you need before cancellation. After cancellation, we target retaining tenant account and website data for 90 days, unless deletion is requested earlier or legal, billing, tax, security, backup, or dispute obligations require a different period.
10. Third-party Services
The service depends on third-party providers, including Cloudflare, WorkOS, Stripe, Resend, and PostHog. Their outages, API changes, compliance requirements, or account decisions may affect the service.
11. Disclaimers
The service is provided on an "as is" and "as available" basis to the extent allowed by law. We do not guarantee that a website will generate leads, rankings, revenue, or a particular business outcome.
12. Liability
To the extent allowed by law, Aspire's liability is capped at the fees you paid for the service in the 12 months before the event giving rise to the claim. This cap does not limit liability that cannot be excluded or limited under applicable law, including non-excludable Australian Consumer Law guarantees.
13. Governing Law
These Terms are governed by the laws of Queensland, Australia. The parties submit to the courts of Queensland, Australia.
